General Terms and Conditions for Gym Memberships - Personal. Sportpraktijk

By signing up for a membership with Personal. Sportpraktijk, the Member acknowledges and agrees to these Terms and Conditions. These Terms and Conditions constitute a legally binding agreement between the Parties.

2. Membership Contract

2.1. Personal. Sportpraktijk offers gym membership contracts with a duration of 1 year, payable on a monthly basis. Membership contracts commence upon acceptance by Personal. Sportpraktijk and continue on a month-to-month basis thereafter unless terminated in accordance with these Terms and Conditions.

2.2. A one-time administration fee of €10 (EUR) is required at the commencement of the membership.

3. Renewal and Termination

3.1. Membership contracts automatically renew for an additional 1-year term, one month before the end of the existing contract. This renewal will occur unless the Member provides written notice of cancellation in accordance with Section 4 of these Terms and Conditions.

3.2. Members may cancel their membership by providing written notice to Personal. Sportpraktijk at least 1 month before the end of the current contract term. Failure to provide such notice will result in automatic renewal for another 1-year term.

4. Cancellation

4.1. Leden kunnen hun lidmaatschap opzeggen door een schriftelijke opzeggingsbrief te sturen naar Personal. Sportpraktijk via e-mail of aangetekende post, ervoor zorgend dat de opzegging ten minste 1 maand vóór het einde van de huidige contracttermijn wordt ontvangen.

4.2. Opzeggingen dienen te worden gericht aan:

4.3. Lidmaatschapsovereenkomsten hebben een duur van 12 maanden. Na de looptijd wordt de lidmaatschapsovereenkomst automatisch met 12 maanden verlengd, 1 maand vóór het einde van de looptijd.

4.4. U kunt de lidmaatschapsovereenkomst op elk moment opzeggen met een opzegtermijn van één maand. De beëindigingsdatum wordt altijd bepaald door de datum van opzegging. Het abonnement eindigt altijd op de laatste dag van de maand volgend op de maand van opzegging.

4.5. Het verzoek tot opzegging kan worden gedaan via de website, de app of in de club. Het verzoek moet ten minste één maand voor de gewenste opzegdatum worden ingediend. U ontvangt een bevestiging van uw opzegging via e-mail.

4.6. Indien de overeenkomst door u wordt opgezegd, zal Personal. Sportpraktijk geen betaalde lidmaatschapsgelden of andere bedragen terugbetalen.

4.7. Wij behouden het recht om de lidmaatschapsovereenkomst te beëindigen indien:

a. U niet aan uw betalingsverplichtingen heeft voldaan overeenkomstig artikel 5.
b. U een van de bepalingen van deze algemene voorwaarden of een van de bepalingen van de huisregels schendt.
c. Wij andere goede redenen hebben, zoals (maar niet beperkt tot) indien u onze medewerkers of andere leden lastigvalt of als uw gedrag een onaanvaardbare last vormt voor andere leden.
d. U valse of misleidende informatie heeft verstrekt bij inschrijving of tijdens uw lidmaatschap.

4.8. In geval van beëindiging zoals bedoeld in artikel 4.7, heeft Personal. Sportpraktijk het recht om onmiddellijk de toegang tot de club te blokkeren en de lidmaatschapsovereenkomst te beëindigen. In dat geval heeft u geen recht op enige terugbetaling van betaalde lidmaatschapsgelden of andere bedragen.

5. Payment

5.1. Memberships are billed on a monthly basis and are subject to a value-added tax (VAT) rate of 6%.

5.2. Payments for memberships will be collected on the 1st day of each month, commencing with the first month of the membership.

5.3. Memberships that commence during the middle of a month will be calculated pro-rata for the initial month.

5.4 All membership types have their own membership rates and conditions, which can be found on the website or at the clubs.

5.5 All membership fees are due and payable in advance by SEPA direct debit.

5.6 Personal. Sportpraktijk also offers its members the option to pay for the agreed contract period in advance in one installment through online payment or card payment at the counter (if you opt for an annual agreement with full prepayment). In this case, no monthly SEPA direct debit will be initiated. Each invoice must be settled within 7 calendar days of receiving the invoice.

5.7 If we are unable to debit your payment for any reason (e.g., reversal, insufficient funds, etc.), we will resend the direct debit to your bank. If you fail to meet your payment obligations for a period of two months, the agreement will be terminated, and a termination fee of 300.00 EUR will be payable.

5.8 If you still do not meet your payment obligations even after we have issued a formal notice, you will be in default. At that point, we have the right to claim the amounts due, along with statutory interest (calculated from the due date of the amounts owed), as well as a lump-sum compensation of 10% on the outstanding amounts, with a minimum of 100 EUR for all extrajudicial costs. However, we retain the right to claim a higher compensation, subject to proof of actual damages suffered. We also reserve the right to terminate the agreement with immediate effect, without any compensation being due to you. We have the right to assign the claim to a debt collection agency, among other things.

5.9 Personal. Sportpraktijk reserves the right to change the membership fees and services offered with a two-month notice period. If you do not agree with the proposed changes, you have the right to terminate your membership with a one-month notice period.

6. Competent Court for Disputes

Any disputes arising out of or in connection with these Terms and Conditions shall be subject to the exclusive jurisdiction of the Mechelen district court.

7. Amendments to Terms and Conditions

Personal. Sportpraktijk reserves the right to amend these Terms and Conditions at its discretion. Members will be notified of any changes in advance.

9. House rules

- Personal. Sportpraktijk reserves the right to change the opening hours, schedules, house rules, and instructors.
- Personal. Sportpraktijk is not obligated to compensate for any cancellations of classes or other services.
- Appropriate sportswear, including sports footwear, is necessary for participation in sports activities.
- The use of towels is mandatory in the gym and sauna for hygienic reasons.
- Equipment and machines must be left in an orderly condition after use.
- Smoking is prohibited in the building.
- Pets are not allowed in the building.
- The use or sale of prohibited substances in the gym is not allowed.
- Personal. Sportpraktijk reserves the right to refuse or deny access and terminate membership for individuals whose behavior does not comply with the house rules.
- Lockers may only be used when the person using the locker is present in the gym.
- Repeated failure to follow the rules for online reservation of group classes may result in a temporary or permanent ban on scheduling classes.
- You should be aware that images may be taken for promotional purposes. You give Personal. Sportpraktijk permission to use those images.

10. Force Majeure

10.1 In case of force majeure, we are not obliged to fulfill our obligations under the agreement. In that case, we can suspend our obligations for the duration of the force majeure situation.

10.2 Force majeure refers to any circumstance beyond our control that prevents the fulfillment of our obligations under the agreement, whether or not temporarily, such as (but not limited to) war, riot, pandemic, epidemic, natural disasters, strikes, lockouts, fire, machine breakdown, network failures, or failures in the supply of energy or resources.

10.3 If the force majeure situation lasts longer than 1 month, both parties are entitled to terminate the agreement with immediate effect. In that case, you are liable for all membership fees that would have to be paid until the end of the agreement term.

11. Right of Withdrawal

11.1 This article only applies if you have registered via our website.
11.2 If you want to exercise your right of withdrawal, you must inform us within 14 calendar days from the day of registration by e-mail (info@personal-mechelen.be) or by letter (Geerdegemdries 27H, 2800 Mechelen).
11.3 During this 14-day cooling-off period, we may charge the membership fees pro-rata (from the activation of the membership until the day of cancellation) if you have used the membership during this period, including any registration fees.
11.4 If you decide to withdraw from your agreement within the 14-day cooling-off period and the membership has not been used during that period, the cancellation is free of charge.
11.5 We will refund all membership fees, excluding administration or transaction fees, within 14 days of receiving your withdrawal request.

12. Liability

12.1 The use of the club's facilities and services is at your own risk. Personal. Sportpraktijk is not liable for any injuries or damage to health incurred during your visit to the club, unless it is a result of an intentional act or gross negligence by Personal. Sportpraktijk.

12.2 Personal. Sportpraktijk is not liable for loss, theft, or damage to your property.

12.3 Personal. Sportpraktijk is not liable for any indirect or consequential damage (including loss of income) that may result from your visit to the club or the use of its facilities and services.

12.4 Personal. Sportpraktijk is not liable for any damage or costs arising from the termination of your membership agreement, except in cases where such termination is due to an intentional act or gross negligence by Personal. Sportpraktijk.

12.5 Personal. Sportpraktijk is not liable for any damage or costs arising from the inability to make a reservation for a group class.

13. Personal Data

13.1 In order to fulfill your agreement, we have access to your personal data. Personal. Sportpraktijk processes your personal data in a fair and careful manner and in accordance with the applicable laws and regulations, such as the General Data Protection Regulation (GDPR).

13.2 The privacy statement of Personal. Sportpraktijk outlines the data processed by us, the purposes for which we do so, and how personal data is handled. It also explains how individuals can exercise their rights regarding the processing of their personal data. The privacy statement of Personal. Sportpraktijk can be found on our website.

13.3 To protect the safety of people and property in and around our clubs, we use video surveillance to monitor the club 24 hours a day. Video and audio surveillance are limited to the sports area and are not present in the toilet, shower, and changing rooms.

14. Changes to Data

14.1 Changes in your personal situation (e.g., address or bank details) should be reported directly to customer service or can be adjusted in your Personal. profile which members can access through our app.

14.2 Failure to report these changes, and if Personal. Sportpraktijk incurs costs to obtain the new personal data, these costs will be charged to the member.
